Terms and Conditions

These Terms govern access to Kul Events, ticket purchases, event listings, organizer tools, digital tickets, and related services.

1. Who We Are and Acceptance of These Terms

Kul Events is an event discovery and ticketing platform operated by Unique Brand Creatives Ltd, trading as Kul Events ("Kul Events", "we", "us" or "our"), from Eldoret, Kenya.

By visiting the platform, creating an account, publishing an event, purchasing or receiving a ticket, joining a waitlist, scanning a ticket, or otherwise using our website, progressive web app, mobile applications, APIs or related services (collectively, the "Services"), you agree to these Terms and the policies linked from them. If you do not agree, do not use the Services.

When you use the Services for an organization, you confirm that you have authority to bind that organization. Electronic acceptance, payment confirmation and platform records may be used as evidence of your agreement and transaction.

2. Eligibility and Accounts

  • You must be at least 18 years old and able to enter a binding agreement to open an organizer account. A parent or legal guardian must supervise purchases made for or by a minor.
  • You must provide accurate, current information and promptly update it when it changes.
  • You are responsible for your credentials, devices and all activity under your account. Notify us immediately if you suspect unauthorized access.
  • We may require email, phone, identity, business, event ownership or payout verification before enabling particular features.
  • Accounts may not be sold, transferred, impersonated or used to evade a suspension without our written approval.

3. Kul Events’ Role

Unless an event page expressly identifies Kul Events as the organizer, the event organizer—not Kul Events—creates and supplies the event. The organizer is responsible for the event, venue, performers, licences, safety, accessibility, entry decisions, published description and event-specific terms.

Kul Events provides technology for discovery, booking, payment collection, ticket delivery, attendance management and support. A ticket purchase normally creates a contract between the attendee and the organizer, with Kul Events acting as the disclosed ticketing and payment technology provider.

We may review organizers and listings, but review or verification is not a guarantee that an event, organizer, venue or attendee will meet every expectation. Nothing in these Terms excludes rights that cannot lawfully be excluded under Kenyan consumer law.

4. Organizer Obligations

  • Publish complete and accurate event information, including the organizer identity, date, time, venue or access method, age limits, accessibility information, ticket inclusions, restrictions, capacity and refund terms.
  • Hold all permissions, licences, rights, insurance and approvals required to promote and deliver the event and use submitted names, logos, images, music or other materials.
  • Set lawful prices, taxes and ticket quantities, prevent overselling, and honour valid tickets sold through the Services.
  • Communicate cancellations, postponements, venue changes, safety information and other material changes promptly to Kul Events and affected attendees.
  • Use attendee information only for delivering the relevant event, necessary service communications, legal compliance and any separately consented purpose.
  • Maintain suitable event security, entry processes and trained personnel, including secure use of organizer dashboards and ticket-scanning tools.
  • Cooperate with support, complaint, chargeback, refund, fraud and regulatory enquiries and provide truthful supporting records when requested.

5. Event Listings and Organizer Content

Organizers retain ownership of content they submit. By submitting content, the organizer grants Kul Events a worldwide, non-exclusive, royalty-free licence to host, reproduce, resize, adapt, display, distribute and promote that content for operating and marketing the Services and the listed event.

Organizers confirm that submitted content is accurate, lawful and does not infringe intellectual property, privacy, publicity or other rights. We may request edits, add safety notices, refuse, pause or remove a listing where reasonably necessary to protect users, comply with law or enforce these Terms.

6. Booking and Order Confirmation

Before paying, review the event, date, ticket type, quantity, attendee details, price, fees, refund terms and any organizer conditions. You are responsible for correcting input errors before submitting the order.

An order is not complete merely because a payment request was initiated. A booking is confirmed when payment is successfully verified where payment is required and Kul Events issues a confirmation or ticket. We may cancel duplicate, unpaid, fraudulent, technically erroneous or capacity-exceeding orders and return verified funds where appropriate.

7. Prices, Fees, Taxes and Payments

  • Prices are shown in the currency displayed at checkout. Applicable platform, processing, delivery, tax or organizer charges should be displayed before confirmation.
  • Available payment methods may include M-Pesa STK through Co-operative Bank and approved manual or third-party methods. Your provider may apply its own terms and charges.
  • You authorize the payment provider and Kul Events to process the amount shown and exchange the transaction information needed to authenticate, complete, reconcile or refund the payment.
  • Do not share an M-Pesa PIN, card PIN, password or one-time code with Kul Events, an organizer or support personnel. Kul Events does not need those credentials to confirm a payment.
  • Organizer commissions, processing charges, settlement timing, withdrawal methods, reserves and other commercial terms are those displayed in the organizer dashboard or separately agreed with the organizer.

8. Tickets, QR Codes and Entry

  • Tickets may be delivered by email, account, downloadable document, Apple Wallet, Google Wallet or another stated method.
  • A ticket and its QR code or booking reference are unique credentials. Keep them private. Copying, altering, forging, reselling outside an authorized flow or sharing a code publicly may invalidate the ticket.
  • The first valid scan or redemption may be treated as use of the ticket. A screenshot, duplicate copy or proof of payment alone does not guarantee entry after a ticket has been used, cancelled or refunded.
  • Bring any identification, age evidence or supporting document specified on the event page. The organizer or venue may refuse entry for lawful safety, capacity, age, conduct or ticket-validity reasons.
  • Ticket transfers or name changes are permitted only when the relevant event and available platform functionality allow them.

9. Event Changes, Cancellations and Refunds

The event-specific refund policy shown before purchase applies together with our Refund Policy and mandatory consumer rights. Unless required by law or approved under the applicable policy, a change of mind, failure to attend, travel difficulty, late arrival or refusal of entry for breach of event rules may not qualify for a refund.

If an event is cancelled, postponed or materially changed, the organizer is responsible for promptly providing instructions. Kul Events may assist with notices and verified refunds, but refund timing can depend on organizer approval, available settlement funds and the original payment provider.

Platform or processing fees are refundable only where the checkout terms, event policy or applicable law require it. Used, scanned, transferred, refunded or fraudulently obtained tickets may be ineligible.

10. Organizer Settlements, Refunds and Chargebacks

Organizer balances are calculated from verified receipts less agreed commissions, processing charges, refunds, reversals, chargebacks, taxes, reserves and other authorized deductions. A dashboard balance is not a bank deposit and may remain subject to reconciliation.

We may delay or withhold a settlement while verifying identity or payout details, investigating suspected fraud, resolving attendee claims, funding refunds or chargebacks, complying with law, or addressing a material breach. Organizers remain responsible for valid attendee refunds and transaction reversals connected with their events.

11. Acceptable Use

You must not use the Services to:

  • commit fraud, launder money, evade tax, facilitate unlawful activity or misrepresent an event, identity, affiliation or payment;
  • list content or events that exploit children, promote violence or unlawful discrimination, infringe rights, are deceptive, unsafe or prohibited by law;
  • interfere with security, probe vulnerabilities, introduce malicious code, scrape at unreasonable volume, bypass access controls or disrupt the Services;
  • harvest attendee data, send unauthorized marketing, expose ticket credentials or use personal information outside the purpose for which it was provided;
  • manipulate availability, pricing, reviews, analytics, referrals, payments, scans, refunds or platform records; or
  • use Kul Events branding, content or systems in a way that falsely implies endorsement or authorization.

12. Privacy and Attendee Data

Our Privacy Policy explains how Kul Events handles personal information. Each organizer that receives attendee information is also responsible for its own lawful use, security, retention and response to attendee rights requests.

Organizers must not export, sell, disclose or reuse attendee information for unrelated marketing without a valid legal basis and any required consent. Organizer access may be logged, restricted or withdrawn to protect attendees.

13. Communications

You agree to receive transactional communications needed to operate your account or booking, such as verification messages, payment prompts, tickets, event changes, security alerts, refund updates and support replies. These are not promotional messages and may continue while you have an active booking or account.

Marketing communications are sent only where permitted. You can use an unsubscribe method or contact us to change marketing preferences, although this will not stop necessary service messages.

14. Third-Party Services

The Services may interoperate with payment providers, banks, email and SMS providers, Google Sign-In, Firebase, mapping services, Apple Wallet, Google Wallet, analytics, advertising services and organizer or venue websites. Third parties operate under their own terms and privacy notices.

We are not responsible for an independent third party’s service, availability or content, but we remain responsible for our own obligations and for selecting and managing processors as required by law.

15. Suspension and Termination

We may restrict, suspend or terminate access; pause sales or payouts; cancel affected tickets; or remove content where reasonably necessary for security, suspected fraud, unlawful activity, risk to attendees, repeated complaints, non-payment, breach of these Terms or compliance with a legal request.

Where appropriate, we will give notice and an opportunity to respond. Immediate action may be taken where delay could cause harm, loss, evidence destruction or legal non-compliance. Provisions that by nature should survive termination—including payment, refunds, data protection, intellectual property, liability and dispute clauses—will continue.

16. Service Availability and Disclaimers

We work to provide reliable Services, but internet, mobile network, payment, venue and third-party systems can fail or be interrupted. The Services are provided on an “as available” basis to the extent permitted by law.

Kul Events does not guarantee attendance levels, event quality, organizer solvency, uninterrupted access, or that every listing is error-free. Organizers remain responsible for delivering their events, and attendees remain responsible for travel, accommodation, personal property and compliance with event rules.

17. Liability

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, wilful misconduct, or rights and remedies protected by applicable consumer law.

To the extent permitted by law, Kul Events is not liable for indirect, incidental, special or consequential loss, loss of profit, opportunity, goodwill or data, or losses caused by an organizer, attendee, venue, performer, payment provider or event outside our reasonable control.

For a claim arising directly from Kul Events’ ticketing service, our aggregate liability will not exceed the greater of the platform and processing fees paid to Kul Events for the affected booking or KES 10,000, except where applicable law requires a different result.

18. Indemnity

To the extent permitted by law, an organizer will indemnify Kul Events and its personnel against third-party claims, losses and reasonable costs arising from the organizer’s event, content, breach of these Terms, infringement of rights, misuse of attendee data, failure to provide a lawful refund, or violation of law. This clause does not apply to loss caused by Kul Events’ own negligence, unlawful conduct or breach.

19. Force Majeure

Neither party is responsible for delay or failure caused by events beyond reasonable control, including severe weather, natural disaster, epidemic, civil disorder, government action, utility or telecommunications failure, labour disruption, venue closure or widespread payment-network failure. This clause does not remove an organizer’s duty to communicate with attendees or determine refunds under the applicable policy and law.

20. Changes to the Services or Terms

We may change the Services and update these Terms. The updated version will show a new effective date. Material changes may also be communicated through the platform or by email. Changes apply prospectively; event and purchase terms accepted at checkout continue to govern that transaction unless law requires otherwise.

21. Governing Law and Disputes

These Terms are governed by the laws of Kenya. Please first send a written complaint with the relevant event, booking and requested resolution to info@kulevents.co.ke so we can try to resolve it promptly.

If the dispute is not resolved, the parties may use an appropriate mediation or other alternative dispute resolution process before commencing proceedings. The courts of Kenya have jurisdiction, without preventing a consumer from using any regulator, tribunal or court available under mandatory law.

22. General

These Terms, the Privacy Policy, Refund Policy, event-specific terms and any separately agreed organizer commercial terms form the agreement relevant to your use of the Services. If an event-specific term conflicts with these Terms, it governs only the organizer-attendee aspects of that event and cannot reduce rights that law or Kul Events expressly provides.

If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without our consent; we may transfer ours as part of a lawful reorganization or sale while preserving applicable rights.
